DISTANCE SALES AGREEMENT 1. PARTIES This Agreement is entered into between the following parties under the terms and conditions set forth below. BUYER Full Name: Address: SELLER Full Name / Company Name: Address: By accepting this Agreement, the BUYER acknowledges and agrees that, upon confirming an order subject to this Agreement, they shall be obligated to pay the order amount together with any applicable additional charges, including but not limited to shipping fees and taxes, and confirms that they have been informed accordingly. ⸻ 2. DEFINITIONS For the purposes of this Agreement, the following terms shall have the meanings set forth below: * MINISTER: The Minister of Trade of the Republic of Türkiye. * MINISTRY: The Ministry of Trade of the Republic of Türkiye. * LAW: Turkish Consumer Protection Law No. 6502. * REGULATION: The Regulation on Distance Contracts. * SERVICE: Any consumer transaction, other than the supply of goods, performed or undertaken in return for a fee or other consideration. * SELLER: The company offering goods to consumers within the scope of its commercial or professional activities or acting on behalf of or for the account of such company. * BUYER: Any natural or legal person acquiring, using, or benefiting from goods or services for purposes other than commercial or professional activities. * WEBSITE: The internet website owned and operated by the SELLER. * CUSTOMER: Any natural or legal person requesting goods or services through the SELLER’s website. * PARTIES: Collectively, the SELLER and the BUYER. * AGREEMENT: This Distance Sales Agreement entered into between the SELLER and the BUYER. * GOODS: Movable goods subject to sale, as well as software, audio, visual, and other intangible products prepared for use in electronic environments. ⸻ 3. SUBJECT MATTER This Agreement governs the rights and obligations of the Parties in accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts concerning the sale and delivery of the product(s) ordered electronically by the BUYER through the SELLER’s website, the characteristics and sale price of which are specified below. The prices displayed and announced on the Website are the applicable sale prices. Such prices and offers remain valid until updated or modified by the SELLER. INFORMATION REGARDING THE PRODUCTS 7.1 Product Information The essential characteristics of the goods and/or services (including type, quantity, brand/model, color, and unit quantity) are published on the SELLER’s Website. Where promotional campaigns are applicable, the essential characteristics of the relevant products may be reviewed during the campaign period. Campaign offers remain valid until the stated expiration date. 7.2 Prices The prices listed on the Website are the applicable sale prices. Announced prices and promotional offers remain valid until updated or modified. Limited-time offers remain valid until their stated expiration date. 7.3 Taxes and Payments The total sales price of the goods and/or services, including all applicable taxes, is shown below. GENERAL PROVISIONS 9.1 Acknowledgement and Acceptance The BUYER acknowledges, declares, and undertakes that they have read and understood the preliminary information available on the SELLER’s Website regarding the essential characteristics of the products, sales price, payment method, and delivery conditions, and that they have confirmed this information electronically. 9.2 Delivery Period Each product covered by this Agreement shall be delivered within the period specified in the preliminary information on the Website, depending on the delivery location of the BUYER, provided that such period shall not exceed the statutory maximum of thirty (30) days. ⸻ 10. RIGHT OF WITHDRAWAL Where this Agreement relates to the sale of goods, the BUYER has the right to withdraw from the Agreement within fourteen (14) days from the date the goods are delivered to the BUYER or to the person or organization designated by the BUYER, without providing any reason and without incurring any penalty, provided that the SELLER is duly notified within this period. ⸻ 11. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL The right of withdrawal shall not apply to products prepared in accordance with the BUYER’s specific requests or clearly personalized for the BUYER’s individual needs, including but not limited to underwear, cosmetic products, and other single-use or hygiene-sensitive goods. ⸻ 12. DEFAULT AND LEGAL CONSEQUENCES If the BUYER defaults on payments made by credit card, the BUYER acknowledges, declares, and undertakes that they shall be liable for interest and all related obligations arising under the credit card agreement concluded with the issuing bank. ⸻ 13. COMPETENT AUTHORITY Any disputes arising from this Agreement shall be submitted to the Consumer Arbitration Committee or the Consumer Court located either at the BUYER’s place of residence or at the place where the consumer transaction was conducted, in accordance with applicable Turkish law. ⸻ 14. EFFECTIVENESS Upon completing payment for an order placed through the Website, the BUYER shall be deemed to have read, understood, and accepted all terms and conditions of this Agreement.
